Sam’s Hangout #100 - “CHILD CUSTODY AND CARE”

"Parents are the ultimate role models for children. Every word, every movement, and action affects. No other person or outside force has a greater influence on a child than a parent.” – Bob Keeshan

CHILD CUSTODY AND CARE

Now to our discussion for this weekend! We will be discussing “ChILD CUSTODY AND CARE”. There's been a high rate of divorce in the last few years, and often times, these couples break up on bad terms. For many of them, one thing remains the binding force that keeps them in communication. Their kids. But we know how impossible it is for such couples to keep living together, hence the fight to gain custody of the child/children.

Here’s the question!

In custody battles between parents who are no longer together, what factors do you think should matter most in deciding who the child lives with?

OR

What extra steps do you think the court can take to ensure that the child’s best interest is protected?

Our physical hangout is still on our minds and big plans are being made behind the scenes. Please check our Last Post for updates, and thank you to everyone contributing towards making it a reality.

If you have a topic you would like us to discuss in our future hangouts, please feel free to suggest it to us in the comment section and tag @sam.hangout to it.

Okay Let's Gist!!!

Be as simple and sincere with the discussion, hehehe.

There's more to divorce than the couple just going their separate ways. Sadly true, the kids are always at the receiving end. Little wonder why the society is in shambles today, a lot has really gone wrong.

9 out of 10 kids from a divorced marriage want their parents back together...they're unhappy. These unhappy kids experience difficulty in their academic and social lives.

Divorcing couple should place their kid's interest above theirs for their overall well-being, and leave ego aside. Both parents should be involved in their child's welfare, where it is mandatory that one should take custody, the mother should be the one. No matter how financially capable or caring a man may be, you can't compare him to a woman when it comes to TLC that a child deserves.

Besides, no woman will care for a child more than the biological mother. However, the emotional and psychological wellbeing of a child should be greatly considered before anything else.

Huhm, this is a deep one.
And I really can't wait to read from you all, meanwhile here's my own 2 cent. Abi na 50cent 😜😁...

I feel in cases like that, what should come first and should be considered is the child's/children emotional safety. It shouldn't ever be about who wins and the likes, it should be about who's always present, who attends little things such as PTA meetings, who knows the child more and understand his/her routines. And all this is something the court itself can work on, they can speak to the child/children if he/she is old enough, they can invite his/her class teacher over and ask them some questions, they can as well ask neighbours about stuff and get to know how each parents react, attend, care, and behaves with the child. The child needs comes first, and this needs goes beyond luxuries. Talk of where he/she feels safe more and the likes...

Also, if the child is still very little, I would suggest it's best to remain with the mother, but then again...it depends. We've heard stories and seen a whole lot of things.

In short, whatever decision that will be made must be one that protects the child's/children mental health and show them they are genuinely loved.

"In custody battles between parents who are no longer together, what factors do you think should matter most in deciding who the child lives with"?

Here is my take;
In custody battles between separated parents, courts mostly focus on the child's best interests above all else, as required by laws like Nigeria's Child Rights Act.

This means decisions aren't just about who the parents want or their money, but what truly helps the child grow strong and happy.

From child custody cases I have watched, courts don't let parents' selfish wishes or one parent's bank account decide who gets the kids. Instead, they focus only on what's best,like a stable home, love and growth,putting the kid's future first.They also look at factors like;

The Child's emotional bond: Which parent has the strongest daily tie, like feeding, schooling and playing? These bonds beat cash every time.

Stability and home life:Keeping school, friends and routine matters a lot, sudden moves far away, can harm the child.

Parental fitness:Does the parent avoid violence, drugs, or neglect? A safe, loving home always wins over chaos.

Child's wishes (if mature):Kids over 7-10 get heard, but only if their choice makes sense, not pushed by a parent.

Co-parenting ability:The parent who backs the other's role, even after fights, shows maturity and kid-first thinking(that's means putting your children's needs, happiness and well-being ahead of your own ego, anger, or personal grudges, especially after a breakup).

In conclusion, money helps with needs like school fees and the likes, but love and care beat wealth every time.Courts value emotional love and daily care (like hugs, bedtime stories and stability) more than a fat wallet alone. Thank you.

On this matter I will always suggest the most intentional , present and consistent parents take full custody .
I have stayed around kids and I know the importance of being present at every stage of their growth, learning and developmental process, it matters alot, it builds a different kind of bond and builds them to be better adults.

Peaceful co- parenting isn't a big deal too, I don't see any reason two adults won't cooperate and make their decision to seperate not to affect the children by all means.
Children are the real victims when both parent divorce in a chaotic way.
Putting your child first in this situation is very necessary.

@yechee why is this topic reminding me of Davido and Sophia custody battles for Imade earlier this week 😂, well I'm very happy Sophia won 🥳.

So thoughtful of you dear...
And of a truth, the child should come first, every decision taken must revolve around the child and not the parents..most parents are only interested in winning the case and showing they can do and undo.... let's not go into David's own sha

Thanks for sharing.

0.00000000 BEE

Hmm, this is a very thoughtful topic . I will give my little idea on this.
Everybody deserves to love and be loved, in a case where couples don't love each other again,I wouldn't advise anyone stay and give up his or her mental stability up just because of the children but nevertheless they must come in agreement on how to make sure the children also don't lack their parents love and care. To decide who the children should stay with,at a very young age like infant, they should probably stay with the mother because no matter how crazy a woman is,she cannot harm her child, she will definitely seek for the safety of her child but a teenager can decide whoever he or she wants to go with, either mom or dad that doesn't mean he or she shouldn't see the other parent again or not receive love form him or her.

Court should look into the divorce issue more in Nigeria, cos a lot of people are out there who leave all the responsibility of two parents to one parents just because they aren't together anymore and the issue of a parent condemning the other just because he or she is not present should be counsel by the court to couples because it's affects the children mental health and understanding of love.Alot of people are suffering from trauma from their parents lovelife. And again, the court should also counsel children whose parents divorce that they shouldn't hate their parents, every human is prone to make mistakes, their parents are also in this life for the first time, so they should forgive them of the mistakes of what they brought out to them .
