If there's one canonical event in the life of anyone involved with cryptocurrencies, it's undoubtedly that wonderful promise of getting rich effortlessly, which often appears in WhatsApp groups or that an influencer mentions on social media or Instagram. Well, many times it comes to nothing, but it can also turn this scenario into a federal lawsuit where things get really heated.
The Commodity Futures Trading Commission (CFTC), the United States' derivatives regulator, is suing Cash FX Group in a cryptocurrency exchange case totaling around $950 million. In the defendant's dock are Brazilian CEO Huascar Jose Lopez Castillo, The Conversion Pros and its CEO Ronald Pope, as well as Justin Halladay. The lawsuit was filed in the District Court for the Middle District of Florida.
According to the CFTC, the script for this scheme is one we've seen thousands of times before: the operation functioned like a Ponzi scheme in a multi-level marketing format, raising funds with the story of a collective fund that would trade foreign exchange contracts in the retail market.

Yes, you read that right, they were advertising these high returns "per week." Anyone who has spent time in the market knows that high and surreal returns are not strategic concepts, but rather red flags and cause serious suspicion.
And what was behind these promises? According to the regulator, almost none of it was real trading. Most of this money was allegedly diverted through new investments, simulating fictitious profits, with millions going directly into the pockets of each defendant. Participants also allegedly received false statements and accumulated losses of at least $406 million.
The number of accounts affected/defrauded becomes even more frightening: more than 400,000 between 2019 and 2023, and more than 6,000 of them (in the US) deposited at least $27 million. Cryptocurrencies appear as a kind of payment conduit, used to receive deposits and move funds internally.
Finally, it's worth remembering that this is a civil action and not a conviction that will be executed immediately. The accusations still need to be proven, but this serves as a warning to everyone, especially those in Brazil, where this type of scheme circulates with enormous ease, playing with people's dreams and financial desperation.
Crypto is an incredible concept, but it doesn't transform impossible and miraculous promises into something tangible. If someone claims to guarantee 15% weekly returns with a magical AI, the right question isn't how much you'll earn, but who will ultimately bear the losses. Be careful with everything and everyone!

A Comissão de Negociação de Futuros de Commodities (CFTC), órgão regulador de derivativos dos Estados Unidos, está processando o Cash FX Group em um caso envolvendo uma corretora de criptomoedas, totalizando cerca de US$ 950 milhões. A proposta de venda era convincente e tinha um pouco de tudo: traders experientes, algoritmos proprietários, inteligência artificial e retornos de até 15% por semana. Sim, você leu certo, eles anunciavam esses altos retornos "por semana". Qualquer pessoa que já tenha investido no mercado sabe que retornos altos e surreais não são conceitos estratégicos, mas sim sinais de alerta que levantam sérias suspeitas.
E o que estava por trás dessas promessas? Segundo o órgão regulador, quase nada disso era negociação real. A maior parte desse dinheiro teria sido desviada por meio de novos investimentos, simulando lucros fictícios, com milhões indo diretamente para os bolsos de cada réu. Os participantes também teriam recebido extratos falsos e acumulado perdas de pelo menos US$ 406 milhões.
O número de contas afetadas/fraudadas é ainda mais assustador: mais de 400.000 entre 2019 e 2023, e mais de 6.000 delas (nos EUA) depositaram pelo menos US$ 27 milhões. As criptomoedas surgem como uma espécie de canal de pagamento, usado para receber depósitos e movimentar fundos internamente.
Por fim, vale lembrar que esta é uma ação civil e não uma condenação que será executada imediatamente. As acusações ainda precisam ser comprovadas, mas isso serve de alerta para todos, especialmente para aqueles no Brasil, onde esse tipo de esquema circula com enorme facilidade, brincando com os sonhos e o desespero financeiro das pessoas.
As criptomoedas são um conceito incrível, mas não transformam promessas impossíveis e milagrosas em algo tangível. Se alguém afirma garantir retornos semanais de 15% com uma inteligência artificial mágica, a pergunta certa não é quanto você vai ganhar, mas quem vai arcar com os prejuízos.
