Women’s Rights in the World and the Importance of an Unbiased Approach

There is no second opinion that the topic of women’s rights has always remained important in the world. On global media especially, all those societies are being criticized that show any form of negligence regarding women’s rights, whether they are European countries or Eastern regions, and whether from a religious perspective it is Islam or any other faith. Therefore, in today’s writing, we will present some thoughts on this very subject.

Respected readers, always remember one principle: whenever we face an issue and listen to only one side, and then claim to have understood the whole story, most of the time we are ninety nine percent wrong. Therefore, in any matter, both sides must be heard. For example, whenever we talk about women’s rights, religions inevitably come under criticism, that just like society and culture, religion has also placed many restrictions due to which women’s rights are being violated.

At this point, it is extremely important to understand a second principle as well: any matter comes into the spotlight for two reasons. First, when there is genuinely a problem, voices are raised. Second, sometimes rumors and propaganda rise to such an extent that even an ordinary matter is made highly prominent.

Now, in the light of these two principles, let us try to look at the reality of the matter with neutrality and from a research based perspective.

Women’s Rights in Islam from a Religious and Legal Perspective

Dear readers, when we study Islam among the religions of the world, we find that it is the central religion of the Muslim world, and this religion claims that it gives women a status that fully corresponds to their nature, dignity, and character.

Let us, in the light of this claim, review women’s rights in the Muslim world from historical, religious, social, and contemporary perspectives.

If we look at the basic rights that Islam has given to women, we learn that Islam grants women complete rights of human equality, spiritual equality, economic freedom, and social protection. The greatest example of this is that the Holy Quran has declared both women and men equally as “human” and “servants of God,” and in this context, their deeds have been placed on equal footing.

Islam has declared education to be a right of women. Accordingly, the Prophet Muhammad ﷺ said: “Acquiring knowledge is obligatory upon every Muslim man and woman.”

Islam is the first system in the world that granted women the legal right to inheritance, and in this regard, an entire chapter of the Quran was revealed in the name of women, Surah An-Nisa.

Islam granted women full authority in marriage and limited authority in divorce, allowing women to marry by their own choice, and if marital harmony is not possible, they also have the right to seek khula (khula: Wife-initiated divorce in Islamic law).

This same religion also recognized the economic independence of women, that a woman is the owner of her wealth and is free to engage in trade, employment, and property ownership.

Role of Women in Islamic History

Dear readers, in this context, if we study the role of women in Muslim history, we find that the respected wife of the Prophet ﷺ, Hazrat Khadijah Al-Kubra رضي الله عنها, was a successful businesswoman who played an economic and social role even before the prophethood of the Prophet ﷺ.

The Prophet’s ﷺ wife Hazrat Aisha Siddiqah رضي الله عنها was simultaneously a scholar of hadith, a jurist, and a woman of political understanding, and thousands of hadiths are narrated from her.

Similarly, his daughter Hazrat Fatimah Al-Zahra رضي الله عنها was an exemplary figure in knowledge, character, and worship.

Among other Muslim women warriors, the name of Nusaybah bint Ka‘b is also mentioned, who actively participated in battles and defended the Prophet ﷺ during the Battle of Uhud.

In short, Islam granted women many rights. This is why the representative poet of Islamic civilization, Allama Muhammad Iqbal, beautifully said while remembering his respected mother:

“Through your upbringing, I became destined among the stars
The house of my ancestors became a treasure of honor
In the register of existence, your life was a golden page
Your life was a complete lesson of both religion and the world”

Contemporary Muslim World and Future Responsibilities

After this, the question arises: what is the state of women’s progress in the modern Muslim world?

In this regard, we also find a positive answer, that Muslim women are proving their worth in numerous fields. For example, take education alone. There are many Muslim countries where special attention is being given to girls’ education. Turkey, Indonesia, and Malaysia are among such Muslim countries. When we examine their education systems, we find that women are playing a prominent role in higher education and research. In Iran, the proportion of female students in universities is even more than fifty percent.

The same is true in politics. In our beloved country Pakistan, Mohtarma Benazir Bhutto has been the world’s first Muslim woman Prime Minister. In Bangladesh, both Hasina Wajed and Khaleda Zia have served as Prime Ministers. Similarly, in Indonesia, Turkey, Morocco, and other countries, women have notable representation in parliaments.

Likewise, when we talk about women’s participation in economy and trade in Muslim regions, we find that women are emerging as bankers, doctors, engineers, teachers, and business personalities, and this trend continues to grow.

However, along with all these positive developments, it is also an established fact that we face many challenges and issues that must be addressed in a timely manner. As a Muslim society, we observe that Shariah has granted many rights to women, but the real issue lies in implementation. There are several obstacles, such as cultural customs, lack of proper education, weak enforcement of existing laws, and incorrect religious interpretations.

But dear readers, it is said that diagnosing the disease is half the cure. Since we are aware of our problems, it is hoped that we will soon be able to control them and succeed in granting women the pure rights that our religion has defined for them. So what preparation should we make in this regard?

First of all, we must create awareness regarding the rights Islam has defined for women and how they should be fulfilled. Religious scholars must contribute in this matter so that a balanced, scholarly, and research based opinion regarding women can be developed in society.

We must also strengthen Islamic education among our women so that they can understand their own rights. Effective enforcement of state laws is also a crucial milestone in this regard. Therefore, the rulers of Muslim states should formulate clear policies, in the light of Islamic principles, for the protection and development of women.

In summary, today’s discussion can be concluded in three points. First, the status of women in the Muslim world, their rights, and their freedom are all part of Islam’s natural, balanced, and justice based system.

Second, when we investigate the causes of existing problems, we find that the root cause is not religion, but misunderstanding or incorrect interpretations of it.

Third, today’s Muslim women should come forward with knowledge, awareness, and character, and fulfill their social, educational, political, and economic responsibilities in accordance with Islamic principles. Only then can the Muslim world truly become a developed, balanced, and just society.

عورتوں کے حقوق کا عالمی تناظر اور غیر جانبدار رویہ

اس میں دو رائے نہیں کہ دنیا میں عورتوں کے حقوق کا موضوع ہمیشہ سے اہم رہا ہے ، اور عالمی میڈیا پر خاص طور پر ایسے تمام معاشروں کو تنقید کا نشانہ بنایا جارہا ہے، جو عورتوں کے حقوق میں کسی بھی حوالے سے کوتاہی کرتے ہیں، چاہے پھر وہ یورپی ممالک ہوں، یا مشرقی خطے، مذہبی لحاظ سے خواہ وہ اسلام ہو یا کوئی اور دین۔
چنانچہ آج کی تحریر میں ہم اسی موضوع پر کچھ خامہ فرسائی کریں گے۔

محترم قارئین! ہمیشہ ایک اصول یاد رکھیں کہ ہم جب بھی ہمارے سامنے کوئی مسئلہ آتا ہے اور ہم کسی ایک فریق کی بات سنتے ہیں، اور اپنے تئیں پورا قصہ سمجھنے کا دعویٰ کر بیٹھتے ہیں، تب اکثر ہم 99 فیصد غلط ہوتے ہیں، لہٰذا کسی بھی معاملے میں دونوں فریقوں کی بات سننی چاہیے، مثلاً جب بھی ہم عورتوں کے حقوق پہ بات کرتے ہیں، تو لازماً مذاہب تنقید کی زد میں آتے ہیں،کہ سوسائٹی اور معاشرے کی طرح مذہب نے بھی بہت سی رکاوٹیں لگائی ہیں، جن کی وجہ سے عورتوں کے حقوق پامال ہو رہے ہیں۔

اس موقع پر دوسرا اصول یہ سمجھنا بھی انتہائی اہم ہے کہ کوئی بھی معاملہ دو وجہ سے ہائی لائٹ ہوتا ہے اول یہ کہ واقعی متعلقہ معاملے میں کوئی مسئلہ ہوتا ہے تبھی آواز اٹھتی ہے، یا یہ کہ بسا اوقات افواہیں اور پروپیگنڈے اتنے زیادہ اٹھتے ہیں کہ کسی عام سی بات کو بہت نمایاں کردیتے ہیں۔

اب مذکورہ دو اصولوں کی روشنی میں ہم ذرا غیر جانبدار ہوکر تحقیقی نقطۂ نظر سے دیکھنے کی کوشش کرتے ہیں کہ آخر معاملہ کی حقیقت کیا ہے۔

اسلام میں عورت کے حقوق کا شرعی اور قانونی پہلو

قارئین کرام! دنیا بھر کے مذاہب میں سے جب ہم دین اسلام کا مطالعہ کرتے ہیں، تو ہمیں پتہ چلتا ہے کہ یہ مسلم دنیا کا مرکزی دین ہے، اور یہ دین دعویٰ کرتا ہے کہ وہ عورت کو وہ مقام دیتا ہے جو اس کی فطرت، عزت اور کردار سے عین مطابقت رکھتا ہے۔

آئیے، اس دعوے کی روشنی میں مسلم دنیا میں عورتوں کے حقوق کا تاریخی، شرعی، سماجی اور موجودہ تناظر میں جائزہ لیں۔

اگر ہم ان بنیادی حقوق کو دیکھیں جو دین اسلام نے عورت کو دیے تو ہمیں معلوم ہوگا کہ اسلام عورت کو انسانی مساوات، روحانی برابری، معاشی آزادی اور سماجی تحفظ کا مکمل حق دیتا ہے، جس کی سب سے بڑی مثال یہ ہے کہ قرآن کریم نے عورت اور مرد دونوں کو یکساں "انسان" اور "عبد" قرار دیا گیا ہے، اور اس پیرائے میں دونوں کے کاموں کو برابر قرار دیا ہے۔

دین اسلام نے تعلیم کو عورت کا حق قرار دیا ہے، چنانچہ حضور ﷺ نے فرمایا:
"علم حاصل کرنا ہر مسلمان مرد و عورت پر فرض ہے۔"

اسلام دنیا کا پہلا نظام ہے جس نے عورت کو قانونی طور پر وراثت کا حق دیا، اور اس حوالے سے قرآن مجید کی پوری ایک سورت عورتوں ہی کے نام سے النساء نازل فرمائی۔

اسلام نے اسے نکاح کا مکمل اور طلاق کا کچھ صورتوں کے ساتھ اختیار دیا ہے کہ عورت اپنی مرضی سے نکاح کر سکتی ہے اور اگر شوہر کے ساتھ نباہ نہ ہو تو اسے خلع لینے کا حق بھی حاصل ہے۔

اسی مذہب نے عورت کی معاشی خودمختاری کو بھی تسلیم کیا، کہ عورت اپنے مال کی مالک ہے، اور وہ تجارت، نوکری اور جائیداد خریدنے میں آزاد ہے۔

مسلم تاریخ میں خواتین کا کردار

قارئین کرام! اسی تناظر میں اگر ہم مسلم تاریخ میں خواتین کے کردار کا مطالعہ کریں تو ہمیں پتہ چلے گا کہ جناب رسول اللہ ﷺ کی رفیقہ حیات حضرت خدیجہ الکبریٰ رضی اللہ عنہا ایک کامیاب تاجر خاتون تھیں، جنہوں نے نبی علیہ السلام کی نبوت سے قبل بھی معاشی و سماجی کردار ادا کیا۔

حضور ﷺ کی دوسری بیوی عائشہ صدیقہ رضی اللہ عنہا ہیں، جو بیک وقت محدثہ، فقیہہ اور سیاسی فہم رکھنے والی خاتون تھیں، اور ان سے ہزاروں احادیث مروی ہیں۔

اسی طرح آپ علیہ السلام کی صاحبزادی فاطمہ الزہراء رضی اللہ عنہا ہیں، جو علم، کردار اور عبادت میں اعلیٰ نمونہ تھیں۔

نیز دیگر مسلم خواتین مجاہدات میں نسیبہ بنت کعب جیسوں کا نام بھی آتا ہے، جنہوں نے باقاعدہ جنگوں میں شرکت کی اور غزوہ احد میں نبی کریم ﷺ کا دفاع کیا۔

غرض یہ کہ دین اسلام نے عورتوں کو کافی حقوق دیے ہیں، یہی وجہ ہے اسلامی تہذیب و تمدن کے نمائندہ شاعر علامہ محمد اقبال نے اپنی والدہ محترمہ کو یاد کرتے ہوئے کیا خوب کہا:

"تربیت سے تیری میں انجم کا ہم قسمت ہوا
گھر مرے اجداد کا سرمایہء عزت ہوا
دفتر ہستی میں تھی، زریں ورق تیری حیات
تھی سراپا دین و دنیا کا سبق تیری حیات"

موجودہ مسلم دنیا اور آئندہ کی ذمہ داریاں

اس کے بعد سوال پیدا ہوتا ہے کہ آج کی جدید مسلم دنیا میں عورتوں کی ترقی کی کیا صورت حال ہے؟

تو اس حوالے سے بھی ہمیں مثبت جواب ہی ملتا ہے کہ بے شمار میدانوں میں مسلم خواتین اپنا لوہا منوا رہی ہیں، مثال کے طور پر تعلیم ہی کو لےلیجئے، کتنے ہی مسلم ممالک ہیں، جہاں لڑکیوں کی تعلیم پر خصوصی توجہ دی جا رہی ہے، ترکی، انڈونیشیا، ملائیشیا سب مسلم ممالک شمار ہوتے ہیں، اور اگر یہاں کے نظام تعلیم کے بارے میں جانیں تو معلوم ہوگا کہ یہاں خواتین اعلیٰ تعلیم اور ریسرچ میں نمایاں کردار ادا کر رہی ہیں۔ ملک ایران میں تو یونیورسٹیوں میں طالبات کا تناسب 50 فیصد سے بھی زیادہ ہے۔

یہی حال سیاست کا ہے، وطن عزیز پاکستان میں محترمہ بینظیر بھٹو دنیا کی پہلی مسلم خاتون وزیراعظم رہ چکی ہیں۔ بنگلہ دیش میں حسینہ واجد اور خالدہ ضیاء، دونوں وزیراعظم رہ چکی ہیں۔ اسی طرح انڈونیشیا، ترکی، مراکش وغیرہ میں پارلیمنٹ میں خواتین کی نمایاں نمائندگی ہے۔

اسی طرح مسلم خطوں میں اگر معیشت و تجارت کے حوالے سے عورتوں کے حصے کی بات کی جائے تو پتہ چلتا ہے کہ یہاں خواتین بینکار، ڈاکٹرز، انجینئرز، اساتذہ اور کاروباری شخصیات کے طور پر سامنے آ رہی ہیں۔ اور آئے دن یہ سلسلہ بڑھ ہی رہا ہے۔

تاہم ان تمام خوش آئند امور کے ساتھ ساتھ یہ بھی طے شدہ بات ہے کہ ہمارے چیلنجز اور مسائل بھی بہت ہیں، جن سے ہمیں بروقت نبردآزما ہونا پڑے گا، مثال کے طور پر بطور مسلم معاشرہ ہم دیکھتے ہیں کہ شریعت نے عورت کو بہت سے حقوق دیے ہیں، مگر اصل مسئلہ تو ان پر عمل کا ہے، جس میں چند رکاوٹیں درپیش ہیں، مثلاً ہمارے ثقافتی رسوم و رواج، اسی طرح مناسب تعلیم کی کمی، مروجہ قانون کا کمزور نفاذ، اور غلط مذہبی تعبیرات وغیرہ جیسے گھمبیر مسائل بھی ہیں۔

لیکن قارئین کرام! وہ کہا جاتا ہے ناں کہ مرض کی تشخیص کا ہوجانا بھی آدھا علاج ہے، تو ہمیں ہمارے مسائل کا ادراک و احساس ہے، امید ہے ہم ان پر جلد از جلد کنٹرول بھی پا لیں گے، اور عورتوں کو وہ خالص حقوق دینے میں کامیاب ہوجائیں گے جو ہمارے مذہب نے ان کے لیے طے کیے ہیں۔ تو اس حوالے سے ہمیں کیا تیاری کرنی چاہیے؟

سب سے پہلے تو ہمیں اس حوالے سے آگاہی دینا ہوگی، کہ اسلام نے ان کے کیا حقوق متعین کیے ہیں، اور وہ کیسے ادا ہوں گے۔

مذہبی اسکالرز کو اس بارے میں اپنی خدمات دینی ہوں گی تاکہ عورت کے حوالے سے اعتدال پسند، علمی اور تحقیق پر مبنی رائے معاشرے میں پیدا ہو سکے۔

نیز ہمیں اپنی خواتین کی اسلامی تعلیم میں مضبوطی پیدا کرنی ہوگی تاکہ وہ خود اپنے حقوق کو سمجھ سکیں۔

ریاستی قانون کا مؤثر نفاذ بھی اس حوالے سے اہم سنگ میل کی حیثیت رکھتا ہے، لہٰذا مسلم ریاستوں کے حکمرانوں کو چاہیے کہ خواتین کے تحفظ اور ترقی کے لیے اسلامی اصولوں کی روشنی میں واضح پالیسیاں بنائیں۔

گویا آج کی تحریر کا خلاصہ تین باتیں ہیں، پہلی تو یہ کہ مسلم دنیا میں عورت کا مقام، اس کے حقوق، اور اس کی آزادی، سب کچھ اسلام کے فطری، متوازن اور عدل پر مبنی نظام کا حصہ ہیں۔

دوسری بات یہ کہ جہاں مسائل پیدا ہو رہے ہیں ان کی کھوج لگائی جائے تو پتہ چلتا ہے کہ مسائل کا سبب مذہب نہیں، بلکہ اس کی ناسمجھی، یا غلط تعبیرات وغیرہ ہیں۔

تیسری بات یہ کہ آج کی مسلم خواتین کو چاہیے کہ وہ علم، شعور، اور کردار کے ساتھ آگے آئیں اور اپنی معاشرتی، تعلیمی، سیاسی و معاشی ذمہ داریاں اسلامی اصولوں کے ساتھ نبھائیں۔ تب ہی مسلم دنیا حقیقی معنوں میں ترقی یافتہ، متوازن اور انصاف پسند معاشرہ بن سکے گی۔
